    The USCIS determines the terms and conditions that are necessary to be accepted by the immigration applicant for a medical waiver in the Green Card Physical Exam.

    APPLYING FOR WAIVER IN THE USA: If the applicant is applying for adjustment of status in the USA then a form that is known as Form I-601, or the Application for Waiver of Grounds of Excludability has to be filled up. This has to be done along with a payment of fees and presented to the applicant’s USCIS office.

    APPLYING FOR MEDICAL WAIVER OUTSIDE THE USA: If the applicant is applying for an immigration visa abroad, he or she will have to visit the relevant US Consul office there. A waiver application will have to be presented to the authorities. The Consul office will then forward the waiver application to the overseas USCIS office where an appropriate decision will be taken.

    If the applicant is applying for admission into the United States as a refugee, or for Adjustment of Status after one year following the preliminary application as a Refugee or for the granting of Asylum, the USCIS may grant a waiver based solely on humanitarian grounds, especially where there is a problem of family unity. In such a case a Form I-602 will have to be filed, but a fee is not required to be paid in such a case.
